General Terms and Conditions

§ 1 Scope

These General Terms and Conditions apply to all business relationships between Power Packaging s.r.o. (hereinafter the “Supplier”) and its customers (hereinafter the “Client”).

Any deviating, conflicting or supplementary general terms and conditions of the Client shall not become part of the contract, even if known, unless their application is expressly agreed in writing.

§ 2 Conclusion of contract

The Supplier’s offers are subject to change and non-binding. A contract is concluded only upon the Supplier’s written order confirmation or delivery of the goods.

§ 3 Prices and payment terms

The prices applicable at the time of the order shall apply. All prices are exclusive of statutory VAT. Invoices are payable without deduction within 30 days of the invoice date.

§ 4 Delivery

Delivery dates are binding only if expressly confirmed as binding by the Supplier. Partial deliveries are permitted where reasonable for the Client.

§ 5 Retention of title

The delivered goods remain the property of the Supplier until all claims have been paid in full.

§ 6 Warranty and liability

The Supplier is liable for defects in accordance with statutory provisions. The limitation period for claims relating to defects is 12 months from delivery.

For damage caused by slight negligence, the Supplier is liable only in the event of a breach of material contractual obligations, injury to life, limb or health, or fraudulently concealed defects.

§ 7 Applicable law and jurisdiction

The law of the Czech Republic applies. The place of jurisdiction is Prague, Czech Republic, provided the Client is a merchant, a legal entity under public law or a special fund under public law.

§ 8 Privacy

Information on the processing of personal data is available in our Privacy policy.

§ 9 Severability

Should individual provisions of these Terms and Conditions be or become invalid or unenforceable after conclusion of the contract, the validity of the remaining provisions shall remain unaffected.
